License Conditions

General Adaptive Calculation Engine (ACE4J) license conditions:

1. Definitions

"Product" means the current version of Adaptive Calculation Engine (ACE4J) library package.

"Licensee" is any business, organization, or individual exercising permissions granted by this License.

"License" means the terms and conditions for use, reproduction, and distribution as defined in this document.

"Licensor" means the copyright owner or entity authorized by the copyright owner that is granting the License.
2. This irrevocable PERPETUAL worldwide, non-exclusive, irrevocable LICENSE covers the Product.
3. This license gives the holder the right to install the Product according to the terms and conditions of the purchased package. In the case of the free evaluation package, the Product cannot be installed on the production server and can only be used for development and testing purposes.
4. The license holder may not redistribute the Product in its current version or with any modification introduced by the license holder.
5. The license holder CAN NOT redistribute the Product as part of another product without the explicit permission in writing by the copyright holder of the Product.
6. These copyright notices must be included in all copies of the Product, in whole or in part, and all derivative works of the Product.
7. Licensee must comply with all export laws and restrictions and regulations of the United States and/or foreign agencies or authorities.
8. Licensee must not export or re-export the Product or any direct product thereof in violation of any such restrictions, laws or regulations, or without all necessary approval. As applicable, each party shall obtain and bear all expenses relating to any necessary licenses and/or exemptions with respect to its own export of the Product from the U.S. By installing or using the Product, Licensee agrees to the foregoing and represents and warrants that it complies with these conditions.

Trademark

This License does not grant permission to use the trade name, trademark, service mark, or product names of the Licensor, except as required for reasonable and customary use in describing the origin of the Product and reproducing the content of this file.

Limitations of use

The license holder may NOT offer, for free or for a fee, the services provided by the Product in conjunction with its own services as part of a SaaS or a PaaS.

Limitation of liability

In no event, except for the case of an intellectual property claim, shall the copyright holder of the Product be liable for any damages whatsoever, including, but not restricted with lost revenue or profit or other direct, indirect, special, incidental or consequential damages, except to the extent invariable law, if any, provides otherwise.

Limited Warranty

Crystal Prism warrants that licensor is the owner of the Product with authority to license the Product to licensee and that the Product does not infringe on third party intellectual property rights. Licensor agrees to indemnify, defend and hold harmless licensee from any claims either that licensor does not own the Product or that the Product infringes on a third party's intellectual property.

Limitation of Liability

In no event and under no legal theory, whether in tort (including negligence), contract, or otherwise, unless required by applicable law (such as deliberate and grossly negligent acts) or agreed to in writing, shall the owner of the Product be liable to Licensee for damages, including any direct, indirect, special, incidental, or consequential damages of any character arising as a result of this License or out of the use or inability to use the Product (including but not limited to damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses), even if such has been advised of the possibility of such damages.

Disclaimer of Warranty

This Product is provided by the copyright holders and contributors "as is" and any express or implied warranties, including, but not limited to, the implied warranty of merchantability and fitness for a particular purpose are disclaimed. In no event shall the owner be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, even if advised of the possibility of such damage.

Third Party Code

Portions of this Product may include open source software under the Apache License.

Termination of License

In the case of embeded time limits this License and the rights granted hereunder will terminate automatically if Licensee fails to comply with terms herein and fail to cure such breach within thirty (30) days of becoming aware of the breach. Provisions which, by their nature, must remain in effect beyond the termination of this License shall survive.
